1. Agreement to These Terms
These Terms of Service ("Terms") govern your access to and use of Lucid Rare ("Lucid Rare," "we," "us," or "our"), including the Expert Finder features made available through our website and related services (collectively, the "Service").
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
Lucid Rare provides tools to help users discover and organize publicly available information about rare diseases—such as researchers, specialist centers, publications, and organizational resources—based on search queries you provide ("Expert Finder"). The Service may also allow you to save or revisit past searches when that functionality is offered and enabled for your account or session.
We may update, suspend, or discontinue features of the Service from time to time. We will endeavor to communicate material changes in a reasonable manner where appropriate.
3. What Lucid Rare Is Not
Lucid Rare is an information discovery and orientation tool. It is not medical advice, a medical device, telemedicine, or a substitute for care from qualified health professionals.
The Service does not diagnose diseases, recommend treatments, or provide individualized clinical conclusions. You are responsible for how you use information obtained through the Service and for seeking appropriate professional care.
4. Eligibility
You must be able to enter into a binding agreement under the laws that apply to you. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
5. Accounts and Security
Certain features may require an account. You agree to provide accurate registration information and to keep your credentials confidential. You are responsible for activity that occurs under your account, except where caused by our gross negligence or unauthorized access due to a breach of our systems.
Where the Service uses third-party authentication or hosting (for example, Supabase), their terms and policies may also apply to account operations.
6. Acceptable Use
You agree not to:
- Use the Service in violation of applicable law or regulation
- Attempt to gain unauthorized access to the Service, other users' data, or our systems
- Interfere with or disrupt the Service, including by automated means that impose an unreasonable load
- Misrepresent your identity or affiliation, or use the Service to send spam or harmful content
- Reverse engineer, decompile, or attempt to extract source code or models except where permitted by law
- Use the Service to build a competing product by systematic scraping or mirroring without permission
7. User Content
You may submit queries, saved searches, or other inputs ("User Content") as permitted by the Service. You retain ownership of your User Content. You grant us a non-exclusive, worldwide, royalty-free license to host, process, and display User Content solely to operate and improve the Service and as described in our Privacy Policy.
Do not submit sensitive health information you are not permitted to share, or information that violates third-party rights. You represent that your submissions comply with these Terms.
8. Intellectual Property
The Service, including its software, branding, and documentation, is owned by us or our licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable license to access and use the Service for its intended purpose.
Open data and third-party materials may appear in results; those materials remain subject to their respective owners' terms and licenses.
9. Third-Party Sources
Expert Finder results may reference or link to third-party publications, databases, organizations, or websites. We do not control and are not responsible for third-party content, availability, or practices. Your use of third-party resources is at your own risk and subject to their terms.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that results will be complete, current, or error-free, or that any particular expert, organization, or publication will be identified. Information discovery tools depend on public and licensed sources that may change.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE OR OUR AFFILIATES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100), IF YOU HAVE NOT PAID US.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
12. Indemnification
You will defend, indemnify, and hold harmless Lucid Rare and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your User Content, your use of the Service in violation of these Terms, or your violation of applicable law or third-party rights.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access if we reasonably believe you have violated these Terms or pose a risk to the Service or other users.
Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive.
14. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Service, you acknowledge that we process information as described there.
15. Changes to These Terms
We may modify these Terms from time to time. We will post the updated Terms and update the "Last updated" date above. If changes are material, we will provide additional notice where appropriate (for example, via the Service). Your continued use after the effective date constitutes acceptance of the revised Terms.
16. Governing Law and Disputes
These Terms are governed by the laws applicable to the operator of Lucid Rare, without regard to conflict-of-law principles, except where mandatory consumer protections in your jurisdiction apply.
Subject to mandatory law, courts in the forum designated by the operator (or otherwise as we may specify in a future version of these Terms) shall have exclusive jurisdiction over disputes, unless a different mandatory venue applies where you reside.
